  1. Object

1.1 These General Conditions, updated in October 2023, are intended, together with the order form, and the other elements referred to therein, to regulate the terms and conditions governing the provision of the RamiroWineCurator Online Store Service ( Osório Silva e Ribeiro, Lda), with headquarters at Rua Fernando Namora Nº22, Rés/Chão Esq 1100-485, Maia, under the unique registration and identification number of legal person nº 500 477 078, with share capital of 300,000, 00 € (euros), hereinafter referred to as RamiroWineCurator.

1.2 The purchase of any product in the RamiroWineCurator Online Store implies acceptance of these General Online Sales Conditions.

1.3 Any and all alcoholic beverages available for sale in the RamiroWineCurator Online Store can only be purchased by people who are of legal age in their country of residence.

  1. Product Information, Prices and Contents

2.1 RamiroWineCurator reserves the right to modify, without prior notice and at any time, the information and commercial offer presented regarding: products, prices, promotions, commercial conditions and services.

2.2 The images that illustrate each product on RamiroWineCurator may differ from the product subsequently delivered, and these same products are also subject to stock outs.

2.3 Despite RamiroWineCurator's efforts, some products may have an inaccurate price, which is why the company checks prices every time it processes orders. Consequently, the prices presented on RamiroWineCurator are merely indicative and do not constitute a contractual proposal. If the actual price of the product is lower than the advertised price, RamiroWineCurator will refund the difference. If the price is higher, RamiroWineCurator will inform the customer of this situation by email and await their decision to accept the new price or cancel the order within 15 days from the date the email was sent.

2.4 Under Portuguese legislation, all prices presented on RamiroWineCurator include the respective VAT rates in force, unless otherwise indicated. Only for resale professionals, the values ​​presented at RamiroWineCurator do not include VAT, with the information “Without VAT” always visible and next to the price.

  1. Order and Payment

3.1 After confirming the order at RamiroWineCurator, an email will be sent to the contact address registered there by the customer when formalizing, with all details about delivery, invoicing, payment information, products and values. RamiroWineCurator suggests that all customers confirm its details. If the customer does not receive the order confirmation email, they are requested to contact RamiroWineCurator using the following contact details so that this notification can be sent again to the customer's email address.

3.2 If any of the details placed by the customer in the order are incorrect and/or the customer wishes to change any information, as long as the order has not yet been shipped, the customer is requested to contact the following contact details as soon as possible so that the change requested by the customer can be made internally. Changes to the details of orders already shipped will have to be analyzed by the RamiroWineCurator team so that, together with the customer, the most appropriate solution can be found.

3.3 All orders at RamiroWineCurator will only be processed after effective receipt of payment. The formalization of the order alone does not constitute a reservation of the products.

3.4 If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by RamiroWineCurator in order to find the most appropriate solution.

3.5 All orders placed at RamiroWineCurator have a maximum payment period of 24 hours. After this period, the order will be automatically cancelled.

3.6 Orders may be canceled when expressly requested by the customer through one of the following contacts , before orders are shipped. After confirming the shipment of the order, the customer is asked to contact RamiroWineCurator so that the most appropriate solution can be found together.

3.7 Through the RamiroWineCurator Online Store, payments are accepted via Multibanco Reference, MBWAY (both for customers with a bank account in Portugal), Bank Transfer and Paypal.

3.8 Order statuses at RamiroWineCurator are comprised of 3 phases: Pending, Processing and Completed.

a) Pending – Waiting for payment to enter the RamiroWineCurator system;
b) In Processing – Phase in which payment has already been received, and the order is in processing and packaging/preparation;
c) On Hold – Waiting for additional confirmations with the customer to proceed with the order. Exceptional phase.
d) Completed – The order has already been dispatched/shipped.

3.9 Payments are received in euros, regardless of the currency in which the transaction is carried out, the conversion rates for payments made in other currencies will have to be borne by the customer.

3.10 Our customer support department, in some cases, may request documents in order to continue processing the order.

  1. Shipping costs

4.1 The respective shipping costs are added to the prices shown on the products for each order, which are calculated based on the sum of two factors: the packaging cost and the transportation cost. The packaging cost for each bottle is €2 (euros). The shipping cost depends on the weight of the order and its delivery destination. This shipping value can be simulated within the shopping cart with the desired products added and filling in all the requested fields in the simulator. The total shipping costs will also be automatically calculated when placing your order in the Online Store. Please note that the factors in this calculation may be variable and may undergo changes without prior notice.

  1. Shipments and Deliveries/Collection in Physical Store RamiroWineCurator

5.1 For orders to be sent to the requested address, the shipping option must be chosen – National Shipping (in the case of Portugal) and International Shipping (in the case of other countries outside Portugal).

5.2 In general, after dispatch, an order at RamiroWineCurator takes a while to be delivered:

- Around 72 hours (working days) in mainland Portugal. Whenever there is a need to transfer stock to the shipping warehouse, in order to complete the order, this period may be longer than 72 hours (working days);
- Approximately 15 working days on the Islands of Madeira and Azores;
- Around 4 to 7 working days in Peninsular Spain;
- Around 6 to 9 working days in the rest of Europe;
- Approximately 15 business days in the rest of the world.

5.3 After orders have been dispatched, information for tracking shipping will be available in the account of customers who have placed the order with registration and a notification is also sent via email with information on the link for tracking shipping to all registered customers and not registered. If for any reason the customer does not receive shipping confirmation, they must contact RamiroWineCurator through one of the following contact details so that all available information regarding the shipping of the order can be sent again.

5.4 After shipping notification, customers must monitor the status of the shipment through the link provided by RamiroWineCurator, so that they are aware of the progress until the moment the order is delivered, as RamiroWineCurator does not notify each change in shipping status.

5.5 All products sent by RamiroWineCurator must be checked upon delivery. If the customer finds that the order is damaged, they must immediately return it to the transport company, duly justify the reason for the return on the carrier's delivery note and immediately notify RamiroWineCurator through one of the following contacts .

5.6 If after delivery, the customer finds that any of the items are not in conformity, they are requested to immediately contact RamiroWineCurator via email ramirowinecurator@gmail.com indicating the order number or the document number that accompanied the order, attaching images of the packaging as received and of all the items, so that the process of investigating the incident can be opened internally and the situation can be resolved as quickly as possible.

5.7 RamiroWineCurator is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages. It is the customers' responsibility to seize their orders, as well as pay customs fees, if any. If products are returned, RamiroWineCurator will only refund the amount corresponding to these products. If you have any questions, you can contact RamiroWineCurator before ordering.

5.8 RamiroWineCurator has contracted services with specialized carriers for the purpose of deliveries in Portugal, Europe and most countries in the world. Every effort is made to meet shipping and delivery deadlines, however, it should be noted that possible delays in deliveries may be beyond RamiroWineCurator's control, and it is not possible, in these cases, to guarantee exact delivery deadlines.

5.9 Most deliveries are made during office hours on working days to the shipping address indicated by the customer when submitting the order.

5.10 If a delivery attempt by the transport company is unsuccessful due to absence, a delivery notice is always left in the customer's mailbox with the carrier's details. Depending on the service and the carrier, orders must be collected at the location indicated by the carrier in the transit notice, or the instructions requested in the same notice must be followed.

5.11 If for any reason the customer is unable to receive the order or pick it up at the location indicated by the carrier, the customer is requested to contact RamiroWineCurator so that together the most appropriate solution can be found.

  1. Applicable law

6.1 RamiroWineCurator recognizes that all its customers have the right to terminate the contracts they have signed with it, allowing them to return, within 30 (thirty) days, products purchased under the terms of Decree-Law No. 109-G /2021 and Decree-Law No. 84/2021, of December 10, 2021.

6.2 For exchanges or returns, the customer is requested to contact RamiroWineCurator via email at ramirowinecurator@gmail.com indicating the number of the order or the document that accompanied it, taking into account the conditions described below in the following topics:

a) To return the order, the product must be in perfect condition, and where appropriate with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.
b) The return of defective products and incorrect shipments will be permitted, with RamiroWineCurator being responsible for shipping and collection costs whenever the customer communicates this circumstance within 30 (thirty) days from the date of receipt of the product .
c) Once the merchandise has been received at our facilities and after validating its condition accordingly, the value will be returned in accordance with the payment method made by the customer, or another solution previously agreed with the customer. .

6.3 RamiroWineCurator assumes responsibility for defects in the origin or raw material of the purchased product and if this is confirmed by RamiroWineCurator's specialized team, the product will be exchanged or returned at no cost to the customer.

6.4 RamiroWineCurator will not accept the return of the product after it has been used, or if it has been altered or modified.

6.5 RamiroWineCurator is not responsible for deficiencies arising from incorrect use, negligence, poor storage conditions or causes of force majeure.

  1. Applicable law

7.1 All purchases made on the RamiroWineCurator website are subject to Portuguese legislation. Any conflict or divergence of interpretation of the General Conditions of Online Sale will be submitted to the competent Portuguese Court.

7.2 If the Customer is located outside mainland Portugal, RamiroWineCurator informs you in advance that any legal proceedings must be exclusively initiated in the Portuguese Courts.

7.3 Under the terms and for the purposes of the provisions of art. 18th of Law no. 144/2015, of 8 September, it is informed that the available CICAP entity is the Porto Consumer Conflict Arbitration Center, with the following contacts:
